Terms and Conditions
INTERPRETATION
“Accommodation Providers” – owners and/or providers of the accommodation, including, but not limited to villas, condos, property, apartments, resorts and other units, which are reserved over caymanexclusiverentals.com for clients;
“Arrival” – means the date on which the services are to be provided or should start being provided by the accommodation providers at the resort;
“Client” – means a person or group of persons who performed booking over caymanexclusiverentals.com website;
“CER” – Cayman Exclusive Rentals Ltd.;
“Contract” – means the agreement for provision of the services;
“Departure” – means the date on which provision of the services are ended;
“Force Majeure” – means an unforeseeable cause beyond control, including, but not limited to natural catastrophic and/or epidemic events, war, acts of terrorism, revolution, closure of borders or other causes with a serious unpredictable affect on both client and the accommodation provider;
“Group” – means a minimum of 2 clients;
“Personal Data” – means personal information, including, but not limited to the following: names, addresses, ID or passport copies and numbers, telephone and/or fax numbers, email addresses, signatures, or any other information belonging to the client or the group;
“Rates” – means fees, taxes and/or any payment regarding services;
“Services” – means the provision of the accommodation;
“Terms and Conditions” – means these terms and conditions, unless stated otherwise;
“Website” – means caymanexclusiverentals.com or CER/CER Ltd.

INTRODUCTION
Caymanexclusiverentals.com (CER Ltd.) is an official accommodation reservation service for the Cayman Islands, acting as a booking agent for accommodation advertised on this website.
By using and visiting the caymanexclsuiverentals.com, the client:
a.)Agrees to the Terms and Conditions
b.)Agrees to have the accommodation reserved by submitting the form provided through the website
FREE OF CHARGE
No fees or any other payment is charged by CER for the services provided as described over the website. The accommodation or other service provider with whom the client enters into a contract will be liable to take payment.
REPRESENTATION OF PRIVATE PROPERTIES
CER is not liable for, and does not guarantee for the accuracy of the accommodation’s representation. By including and offering for rent any accommodation over website, CER does not constitute a recommendation in regard to such accommodation.
MINIMUM AGE REQUIREMENTS
CER will only accept occupancy by a client of minimum 25 years of age, or by a group with at least one client of 25 years of age or older. Such client will be acknowledged by the website to have the right capacity of using the website and creating a legally binding contract.
RATES AND RESERVATION
By booking the accommodation through website, the client is accepting to enter into a contract with the accommodation provider on their rates standard terms and conditions.
The accommodation is provisionally reserved by submitting the existing form through website, in which case the client will be given a reservation number.
After the client’s reservation is checked over and approved, usually within 24 hours during business days, the client will be contacted over email with deposit confirmation and a rental agreement that client needs to sign and return to the accommodation providers office.
In case any rates are not quoted accurately due to technical limitations, the website reserves the right to adjust or correct any errors in the rates once the client’s reservation is received.
The client will always be given an opportunity to accept or decline the reservation before a deposit is processed.
FURTHER CORRESPONDENCE
In case the client have any special requests or questions about their stay, the reservation number given through the website will be used in communication with the website’s or Resort’s staff.
In case the resort staff is not able to contact the client within 48 hours, the reservation may be cancelled, in which case the client will be informed about the cancellation over the email address he/she or it has previously provided.
PERSONAL DATA AND PRIVACY
Clients of the on-line reservation services offered via caymanexclusiverentals.com agree to voluntarily provide accurate personal data and have it processed automatically by the website for the purpose of being provided with the services.
CER guarantees secure transfer and confidentiality of personal data provided by the client, unless having to disclose it to the competent authorities required by the applicable legal regulations in each case.
CONFIRMATION OF THE RESERVATION
Reservation is confirmed after the reservation deposit is processed.
By having the reservation confirmed, the client becomes responsible for making all payments due under the booking.
Reservation is made for the number of guests the client has indicated on the reservation form and will be subject to additional charges or cancellation if the client brings more guests than booked.
FORCE MAJEURE
If the reserved unit becomes unavailable for rental due to force majeure events, CER and the Resort reserve the right at any time to relocate their clients to another unit of equivalent or superior quality.
CANCELLATION POLICY
Cancellation is according to the Resort’s policy, which will be included in the client’s rental contract for a review.
Each accommodation provider individually sets their own rates, specials, deposit and cancellation policies, which may limit or exclude their liability to the client.
CHECK IN/OUT TIME
Client is required to check-in starting from 4:00 PM and to check-out not later than 11:00 AM at the Resort or Property Manager’s office.
Should a client wish for his accommodation to be ready upon his arrival for checking-in, advance notification will be required.
OFFICE HOURS
The Resort Offices work from 9:00AM until 5:00PM from Monday to Friday, and from 8:00AM until 12:00PM on Saturdays. All the Offices are closed on Sundays.
PARKING SPACE
The client is limited with having one parking space (for one vehicle only) per accommodation.
PROPERTY INSPECTION
In the unlikely event that the client has any reason to complain or experiences any problems with the accommodation, the client should immediately inform the accommodation staff, owner or its management, in order to enable them to take appropriate action.
POLICY
Policy of Behavior
The Client is fully responsible for the behavior of his, her or its guests at the Resort and in particular for the orderly conduct of guests who are attending any function or staying at the Resort or otherwise making use of any services of the Resort.
The Client must ensure that no noise or nuisance is caused for the other guests and clients of the Resort, and must comply with any reasonable request of the Resort and its policies whenever applicable.
No parties, weddings and/or other events are allowed at the Resort, without prior written consent by the Property Manager.
Non-Smoking Policy
All the accommodations at the Resort are smoke free.
Smoking is prohibited in all areas of the accommodation property, unless stated otherwise. For breaching this rule, the client will be charged a fee as specified in the “Additional Fees” section.
No Pets Policy
No pets are allowed to enter or stay in any of the accommodation locations.
PROPERTY DAMAGE
The Client will indemnify the accommodation and/or service provider in connection with any loss or damage caused by the client, member of the group or client’s guest in relation to the accommodation property and/or its staff.
ADDITIONAL FEES
Additional fees will be a subject of charge made by the accommodation provider or other liable service provider in the amounts and for the reasons as stated hereby:
A.)Twenty US dollars (20 $) per hour will be charged to the client, if any excessive cleaning of the accommodation is required after departure of the client;
B.)Fifty US dollars (50 $) will be charged to the client, if any keys or door openers are not returned to the Resort’s office prior to departure of the client;
C.)Two hundred and fifty US dollars (250 $) will be charged to the client, if any evidence of smoking is registered in the non-smoking property accommodation.
RESPONSIBILITY OF CAYMAN EXCLUSIVE RENTALS Ltd
CER and its operators/representatives are not to be held responsible for any acts, omissions, breaches, damage or negligence of any accommodation provider or other third party and are not liable for any eventual expenses resulting from the aforesaid.
WEBSITE USE
Caymanexclusiverentals.com may suspend access to the website in regard to internet security reasons, maintenance work or force majeure, with no obligation to compensate or reimburse the client for the period in which the access to the website was suspended.
Weather
If necessary, Cayman Exclusive Rentals will advise clients of its severe weather procedures: if these are not followed the normal cancellation policy applies. Cayman Exclusive Rentals, the property management company, the Property Managers and the property owners are not liable for any loss, damage or injury incurred at any property as a result of weather conditions.
